Rumours of Orange's exit from Dominican Republic disconcert market
    Juan Fernandez Gonzalez | 19-07-2013
It may well be in Orange plans to leave the Dominican Republic telecoms market, but no formal statement has yet been made. According to Reuters, however, the French operator is considering selling its whole business in the Caribbean island for around €900 million.
Orange is rebuilding its financial structure and markets, but no similar move has been made before in Latin America, where the company participates in several telecom markets. The news agency affirms that Orange is already talking with the banks and in the coming days a financial assessor will be named to lead the sale process.
The delay in the establishment of 4G networks may be one of the biggest reasons behind Orange's intention. The Dominican Republic telecoms regulator has been slowing down the 4G transition process due to a possible misuse of the radio electric spectrum and what it was called a "lack of technical capacity".
The reasons were not accepted by Orange, which is currently offering 4G coverage in some parts of the island.
But the question is who may be interested in paying €900 million for this market? Telefónica and América Móvil are the first contenders as they are the biggest groups in Latin America, but both would have difficulty continuing the operation.
Telefónica is also leaving some Latin American countries and focusing in the strongest markets such as Brazil in order to face the current financial crisis. América Móvil is already working in Dominican Republic through Verizon Wireless, and the resulting business concentration would not be accepted by the country's regulator.
Several other groups have been pointed to by the national media. Viettel, Millicom and Digicel could be interested, but the one which has the strongest chance seems to be Cable & Wireless. The British group is already working in Panama and in the past has shown its interest in expanding to the Dominican Republic.

EC launches state aid investigation into Numericable
    July 19, 2013

According to the EC, the sale of public assets to a private enterprise without appropriate compensation can be held to confer an advantage over other competitors and therefore constitutes state aid. The Commission said it doubted that this aid would be compatible with EU rules, in particular because the French authorities had not placed any public service obligations on Numericable.

The investigation relates to the transfer of infrastructure between 2003 and 2006. The cable networks were built under the aegis of the ‘Plan câble’ with support from the French state before being transferred to Numericable and its predecessor companies.

Ziggo targets mobile and WiFi amid weak TV performance
    July 19, 2013

Ziggo logoDutch cable operator Ziggo said it expects improved revenue momentum to come from further investments in WiFi hotspots and mobile, after reporting “limited growth” in digital pay TV.

Announcing its second quarter results, Ziggo said that the already-started rollout of Ziggo WifiSpots “will result in over 850,000 hotspots by the end of the third quarter and close to 1 million before the end of the year.”

It added that it would launch its mobile offering to existing customers in the second half of this year, offering a bundle of call minutes, SMS and mobile data combined with internet access through the Wifi hotspots. It is also investing in customer retention.

The news came as Ziggo reported this its total TV customers – analogue and digital – dipped 4.8% year-on-year to 2.818 million. However it said that digital TV subscribers increased by a slight 3,000 to 2.24 million.

“The number of TV-only subscribers decreased by 21.4% compared with the same quarter last year, to a total of 848,000 as at June 30, 2013. The decrease was mainly caused by the up-selling of the All-in-1 bundle to our TV-only subscribers as well as by churn among TV-only subscribers,” said Ziggo.

“Churn among TV-only subscribers was higher compared to last year as a result of the market moving towards triple-play and increased competition. Churn on all other product lines, and for All-in-1 in particular, is significantly lower compared to churn among TV-only subscribers.”

CEO Bernard Dijkhuizen added: “Our focus on sales of All-in-1 bundles and retention had an adverse effect on marketing initiatives for premium TV, contributing to a limited growth in digital pay TV this quarter.

Overall for the quarter, Ziggo’s revenues were up 1.4% year-on-year to €391.9 million. Net profit was up to €88.9 million, from €64.4 million in Q2 2012. The firm said it now anticipates 2013 organic revenue growth, excluding ‘revenues from other sources’, to be around 1%, whilst adjusted EBITDA is expected to be in line with last year.

Sky Italia: Court must decide on pay-TV ad cap
    July 19, 2013 08.54 Europe/London By Julian Clover

Sky Italia HeadquartersSky Italia has said that under the law it is the Lazio court that will have to decide whether the current advertising limit for pay-TV operators is valid.
The European Court of Justice has said that making a distinction between pay and free-to-air broadcasts is not necessarily a violation of European law.
“It is for the national court to decide whether it is legitimate to have a lower ceiling on pay-TV operator and Sky is confident that the court in Lazio will welcome our reasoning,” the broadcaster said.
The Court of Justice, despite having said the differentiation is not unlawful, regards it as a matter for national courts to decide whether the current rules constitute a restriction on the freedom to provide services.

Fifa and Uefa lose pay-TV rights appeal
    July 19, 2013 08.39 Europe/London By Julian Clover

Fifa and Uefa have lost an appeal against a ruling that the World Cup and European football championships must be shown on free-to-air television in the UK.
It follows a 2011 ruling when the European General Court said the UK could maintain the events on its list of protected events, the so-called ‘Crown Jewels’ of national events.
The judgment said that while only certain broadcasters operating free-to-air channels would be able to bid for the rights, the effect had been created by opting for a business model focusing on exclusive rights.
The two competitions cannot now be sold to pay-TV companies on an exclusive basis. The football bodies had argued that by excluding the pay-TV companies they were unable to achieve the full market value of the tournaments.
The BBC and ITV had already obtained exclusivity on the 2014 World Cup.
